BAGUIO CITY – The city council approved on first reading a proposed cosmetics products regulation ordinance in the Summer Capital aimed at intensifying law enforcement action against manufacturers, importers, distributors and retailers of adulterated and fake products, including the confiscation and destruction of non-Food and Drug Administration (FDA) approved products.
Authored by councilor Leandro Yangot, Jr., the measure cites FDA Act of 2009 that makes it illegal to manufacture, import, export, sell, offer to sell, distribute, transfer, use, promote or advertise any health product that is unregistered, misbranded, adulterated and without proper FDA authorization.
It describes cosmetics as any substance or preparation placed in contact with various external parts of the human body or the teeth and mucous membranes of the oral cavity, with a view exclusively or mainly to clean or perfume them, changing their appearance and correcting body odor, protecting the body or keeping it in good condition.
The ordinance’s objectives include putting an end to the illegal manufacture, importation, marketing and promotion, distribution and sale of unregistered cosmetics products; promoting citizens awareness on the health and environmental impacts in using cosmetics with toxic chemicals; and discouraging consumers from patronizing cheap yet perilous cosmetics products.
It prohibits the following: The manufacture, importation, marketing and promotion, distributio0n and sale of mercury-laded cosmetics in excess of one ppm; the sale, retail or wholesale of unregistered or non-FDA approved cosmetics products; and the open burning, dumping or disposal of illegal, confiscated or recalled cosmetics containing toxic chemicals.
The proposed measure directs the city health services office to lead in the strict implementation of its provisions.** gaby keith
